Property Division

In Arkansas, marital property is subject to equitable division in a divorce. Equitable means fair, which may not result in a 50-50 division of the assets. One person may receive more of the assets than the other if the judge decides that is a fair distribution.

Marital assets may include the home, other real estate, vehicles, personal property, furnishings, retirement accounts, stocks and other financial assets. In addition, you must divide marital debts, including mortgages, car loans, taxes and credit card debt.

Our attorneys understand property division matters and are also experienced estate planning attorneys.

Spousal Support/Alimony

Spousal support is not granted automatically in Arkansas. The court will consider several factors before determining if one party should receive support. The factors involved in the determination include:

  • Each person’s income and earning ability
  • Each person’s needs and expenses
  • The length of the marriage
  • The standard of living during the marriage
  • Whether one person supported the education or training of the other

Depending on the specifics of the marriage, spousal support may be awarded as permanent, rehabilitative or reimbursement alimony.
